Abstract

This study, titled “Challenges in the Implementation of RA 11648: Raising the Age of Sexual Consent to Below 16 Years Old,” explores the impact of the law on minors and its role in protecting children from sexual abuse, harassment, and exploitation. RA 11648 serves as a crucial legal safeguard, but its enforcement presents various challenges. This research aims to identify the difficulties encountered in its implementation, assess its effectiveness in securing children's rights, and provide insights into potential improvements for better protection and awareness. The researchers utilized a simple random sampling technique to select 306 respondents, comprising 7 parents/guardians of rape victims, 27 law enforcers, and 272 social workers. The sample size was determined using Slovin’s Formula. Data collection was conducted through a survey questionnaire, and the collected data were analyzed using percentage and weighted mean to evaluate the challenges encountered in implementing RA 11648. The analysis revealed that most respondents were aged 42-50 years old, with females being the dominant group. The majority were college graduates, married, and had over 10 years of service in law enforcement or social work. Respondents strongly agreed with the implementation of Republic Act 11648, which raises the age of sexual consent to 16 years old and below, particularly in terms of its impact on sexual abuse, desistance from filing cases, and poverty.  The most significant challenge identified was that many cases of statutory rape go unreported due to fear, shame, or lack of awareness of the law, making enforcement difficult. To address this issue, respondents strongly recommended the rigorous enforcement of statutory rape laws to deter offenders and ensure justice for victims. Based on the data gathered, the following recommendations are proposed: Implement programs to destigmatize sexual abuse survivors, emphasizing that they are not at fault and encouraging them to seek professional support as a crucial step in their recovery. Strengthen counseling and psychological support services to help survivors overcome fear, shame, or trauma, empowering them to take legal action. Expand access to free or low-cost legal aid services and financial assistance programs for survivors to ensure they receive the legal protection and support they need. Raise awareness about statutory rape laws through community education programs, ensuring that victims and families are informed about their rights and the legal process. Provide specialized training for law enforcement officers to enhance their skills in handling statutory rape cases, ensuring efficient investigations and just prosecution of offenders.
