Abstract

Animal cruelty penalties vary significantly across countries, ranging from fines and imprisonment to bans on animal ownership and, in severe cases, business closures or institutional legal actions. Although animal welfare laws exist in many regions, enforcement often falls short due to low public awareness, legal gaps, and insufficient resources. This results in numerous cases going unpunished and penalties that are often too mild to discourage repeat offenses. In response, some jurisdictions have implemented tougher sanctions, including felony charges for serious acts of cruelty, reflecting a growing understanding of animals’ capacity for suffering and ethical obligations to protect them. While not all legislation formally recognizes animal sentience, it is clear that both vertebrates and invertebrates are capable of experiencing physical and mental distress. The incorporation of the Five Freedoms into legal frameworks highlights the fundamental commitment to uphold animal welfare. The study included 100 respondents, comprising 15 officials from the Department of Public Order and Safety (DPOS), 15 police officers, 15 members of the Barangay Peace and Order Council (BPAT), 30 community residents, and 25 pet owners. Challenges in Implementing R.A. 8485 in Nagkaisang Nayon, Novaliches, Quezon City  The table presents the top ten challenges encountered in the enforcement of Republic Act No. 8485 (The Animal Welfare Act) in Nagkaisang Nayon, Novaliches, Quezon City, ranked by frequency and percentage of responses. The most frequently reported challenge was identified by 75 respondents, accounting for 11.92% of the total. This was closely followed by a challenge reported by 73 respondents (11.61%), and another by 69 respondents (10.97%). Three challenges ranked 4th, 5th, and 6th, were each cited by 66 respondents, representing 10.49% of responses, indicating that several issues are considered equally significant. The 7th-ranked issue received 63 responses (10.02%), followed by the 8th with 54 responses (8.53%), the 9th with 50 responses (7.95%), and the 10th with 47 responses (7.47%). These figures reflect a range of recurring problems, with relatively small differences in frequency, suggesting that various challenges are perceived as similarly critical by the community. The data underscores the need for comprehensive and collaborative efforts to strengthen enforcement, raise awareness, and address the most pressing obstacles to fully implementing the Animal Welfare Act in the locality. Key Problems Encountered in the Implementation of R.A. 8485 and Corresponding Actions Nagkaisang Nayon, Novaliches, Quezon City. A key issue identified in the implementation of Republic Act No. 8485 in Nagkaisang Nayon is the poor management of animal waste, which poses serious threats to both public health and the environment. Improper disposal can lead to foul odors, the spread of diseases, and environmental contamination. To address this concern, local efforts have focused on promoting proper waste disposal practices. Community members are encouraged to dispose of animal waste in designated areas to minimize health risks and maintain a clean environment.  Another significant problem is the lack of public awareness regarding animal welfare. Many residents remain unfamiliar with the provisions of the Animal Welfare Act and the importance of humane treatment of animals, often resulting in unintended neglect or cruelty. In response, authorities and local organizations have initiated various awareness programs, including seminars, workshops, and information campaigns. These initiatives aim to educate the public about the law and promote responsible pet ownership within the community.
